Operated Equipment Rental: When You Supply the Operator and the Job Becomes Your Liability

Renting a machine bare is a rental business. Renting it with your operator makes you a contractor on someone else\'s job site, and your insurance has to change with it.

The Coverages That Have to Change

Several parts of the program need attention when you add operated service.\n\nGeneral liability classification and limits. Your policy should be written to contemplate operated rental rather than bare rental only. Confirm it in writing. Limits should reflect job site exposure, which usually means a higher primary limit and an umbrella.\n\nWorkers compensation. Your operators are now exposed to construction job site hazards, which affects classification and rate. Make sure the classification reflects the actual work, because a year end audit that reclassifies operators from a rental yard code to an equipment operator code can be expensive.\n\nRiggers liability. If your operated service involves lifting, the property being lifted is in your care, custody, or control, and general liability excludes damage to property in your care, custody, or control. Riggers liability coverage addresses damage to the load. This is one of the most commonly missing coverages in operated crane and boom truck work.

  • Confirm the general liability policy contemplates operated service, not bare rental only
  • Reclassify workers compensation to reflect job site operation
  • Resolve whether each unit is auto or mobile equipment under your policies
  • Add riggers liability for any lifting service, since general liability excludes care, custody, or control
  • Consider professional liability where lift planning or placement judgment is provided

Review Your Rental Program

If you have added operated service, or are considering it, the classification, the riggers liability question, and the contract set all need attention at the same time. We work with equipment, vehicle, and tool rental companies and will review the program against what you actually do today.
